Internet Reservation Service Terms of Use
 
The Internet Reservation Service (hereinafter "Service") refers to the Internet reservation site (the "site") that Sado Steam Ship Co., Ltd. (the "Company") operates on the Internet. When using the Service, you are requested to agree to these Internet Reservation Service Terms of Use (the "Terms of Use") .
 
Article 1 (Scope of Application)
1. The Terms of Use shall apply to the Service.
2. Matters not provided for in the Terms of Use shall be governed in accordance with the Conditions of Carriage set forth by the Company, the Company's Internet Reservation Service Guide, the information and statements on the Company's official website, and/or the membership agreements stipulated by credit card companies.
3. The Company may change the Terms of Use, information and statements by posting on the Company's official website, and, once posted, the Company shall consider that the user has agreed to the change.
 
Article 2 (Member Registration)
1. Users have choice of registering as a member on the service.
2. Individual users ("Users") who have agreed to the Terms of Use shall be able to register as members.
3. Registration by other than the person in question, such as by a representative, and registration of a corporation or a travel agency, shall be invalid.
4. Member registration shall require registration of name, date of birth, contact address, telephone number, e-mail address, a password, and other items stipulated by the Company.
5. A membership number shall be issued upon member registration.
(1) The User shall be responsible himself or herself for the management of the membership number acquired by the User and the registered password, and shall be prohibited to lend, transfer, or otherwise dispose of them to a third party.
(2) The Company shall bear no responsibility in the event that the User incurs damages resulting from the theft of the membership number or the password by a third party.
6. The Company may cancel the membership number without prior notice in the event that any one of the items set forth below applies to the User. The Company shall bear no responsibility for any damages arising from such cancellation.
(1) In the event of registration using a pseudonym or the name of a third party
(2) In the event of registration using a false address, contact details, or e-mail address
(3) In the event of improper use of the Service or non-payment, etc. of fares and charges in the past
(4) In the event that there are errors or irregularities in the registered contact details, and it is not possible to contact the User to confirm reservations, etc.
(5) In the event that the Service has not been used for at least five years
 
Article 3 (Change of Member Registered Information)
1. Users shall update member registration information (name, contact address, telephone number, etc.) promptly on the Service site when there have been any changes.
2. Contact from the Company to the User shall be to the member's registered address, telephone number, or e-mail address.
In the event that a contact notification addressed to the User did not arrive because the User has not carried out update procedures, etc., it shall be deemed that the said notification was made on the date that it would normally have been expected to arrive.
 
Article 4 (Unsubscribing)
1. If the User wishes to unsubscribe, he or she can unsubscribe by carrying out the prescribed procedure
on the site.
 
Article 5 (Handling of Personal Information)
1. The personal information that Users provide when registering at the Site will be used in order to contact Users and for the efficient management of the Company's operations and shall not be diverted to any other purposes.
2. The personal information within the Site shall not be transferred or disclosed to any third party without the consent of the User, except for companies to which the Company contracts some of its operations.
 
Article 6 (Reservations)
1. Applications for reservations for passenger cars, light passenger cars, station wagons, two-wheeled vehicles (excluding those with a side car), buses (excluding large-sized buses), and passengers (excluding for suite rooms and high speed ferry disabled access seats) may be made through the Service. After a reservation application is completed, the reservation will be deemed to have been made when a confirmation e-mail from the Company is delivered to the User.
2. Applications for reservations for vehicles carrying cargo, trucks, large-sized buses, tractors, two-wheeled vehicles with a side car, suite rooms, and high-speed car ferry disabled access seats may not be made through the Service. 3. Second class reservations for car ferry and high-speed car ferry
(1) Second class reservations for the car ferries that service the Niigata route are required for vehicles, groups of 15 or more people. Reservations are not required for groups of up to 14 people traveling in second class without any vehicles. The seating in second class cabins of car ferries is entirely unreserved.
(2) All second class seating on the high-speed car ferries that service the Naoetsu route is reserved, and reservations are required.
(3) When the high-speed car ferry services the Niigata route during car ferry maintenance periods, second is unreserved seating, thus reservations are handled as for a second class cabin on the car ferry.
4. Boarding reservations are accepted from the same date three months prior to the date of embarkation until 19:00 on the day prior to the date of embarkation. In addition, reservations for round-trips not exceeding 10 days are accepted, even when the date of embarkation for the journey is more than the same date three months prior. Acceptance of reservations for the following year begins after the service timetable has been determined. The date when acceptance of reservation will commence might be limited due to the system change or revision of fares. Once the date when acceptance of reservations will commence has been decided, it will be announced on the website.
5. Reservations cannot be made on the day of embarkation.
6. A reservation application is required for each of the vehicles the User brings (including motorcycles and bicycles). In addition, in the case of an application for a round trip that exceeds 14 days, the User shall apply for the outward and return journeys separately.
7. Through the Service, the Company shall apply the corresponding discount to the reserved travel route, except for discounts that require presentation of a certificate, application, etc.
8. In order to make a reservation for unattended shipping of a vehicle (for instance, when using the car ferry for a vehicle and the jetfoil for passengers) please send us an e-mail at e-ship@sadokisen.co.jp.
9. Reservation applications for drinking and no drinking seats in the first class cabin with carpeted floor space on the Niigata route shall be made on the day of embarkation.
10. In order to receive the round-trip discount or the tour discount, please apply for the outward and return journeys at the same time.
11. In order to make a reservation for persons who want disabled access seats on high-speed vessels, please send us an e-mail at e-ship@sadokisen.co.jp
12. Please refrain from improper reservations such as double booking. The Company will cancel member registration and halt the Service without prior notice in the event that any improper reservations are discovered.
 
Article 7 (Payment of Fares and Charges)
1. Please pay required travel fares and charges with cash or credit card (single installment only) at the Company's ticket sales counter.
 
Article 8 (Reservation Changes and Cancellations)
1. With regard to reservation changes and cancellations, the User shall make changes and cancellations through the Service. However, as the reservation system is suspended for 30 minutes from 2.00am to 2.30am, it will not be possible to make changes and cancellations. (The reservation system downtime may be changed when there are late-night services during the summer peak season, etc. In this case, prior notice will be given on the Company's website.) In addition, it will not be possible to make changes or cancellations online after 19:00 on the day prior to the date of embarkation.
2. Upon completion of the procedures for changes through the Service, a response e-mail for completion of reservation changes will be sent. When boarding, the User shall present the response e-mail or the reservation confirmation attached to the response e-mail.
3. When changing from a one-way reservation to a round-trip reservation, the User shall make the change to the reservation through the Service.
4. In the case of a partial change to the reservation, the User shall make the change to the reservation through the Service.
5. Fees for reservation changes and cancellation and unauthorized breach of reservation
(1) There are no fees when a User changes or cancels a reservation through the Site. Users are requested to process a cancellation of a reservation promptly when necessary.
(2) The Company may contact the User in cases where cancellation has not been carried out on several occasions or in cases of frequent cancellation. Where this is malicious, use of the Service may be discontinued, and the Company may claim compensation for damages incurred by the Company.
 
Article 9 (Boarding Procedures)
1. Boarding tickets will be issued at the Company's ticket sales counter. The User shall print out and present the reservation response e-mail showing the reservation number and QR code or the reservation confirmation attached to the response e-mail.
2. For those reservation response e-mails stating that automatic ticket vending machine purchases and procedures are possible, boarding tickets can also be issued by the automatic ticket vending machine.
In this case also, the User shall print out and present the reservation response e-mail showing the receipt number and QR code or the reservation confirmation attached to the response e-mail.
 
Article 10 (Cancellation of Voyage, etc.)
1. Voyages may be cancelled in the event of a natural disaster, fire, shipwreck, breakdown of the vessel to be used, or the occurrence of other unavoidable grounds.
2. In the event that the reserved voyage is cancelled and the transportation agreement between the Company and the User in accordance with the Company's Conditions of Carriage cannot be fulfilled, any of the following measures (1), (2) or (3) shall be taken according to the choice of the User.
(1) Carriage on a voyage on one of the Company's routes which has spare capacity Alternative carriage can only be offered within the capacity of the Company's vessels in use. User's understanding of the circumstances of the Company is requested.
(2) A refund of the fare and charges for the unused portion of the purchased ticket
(3) Extension of the period of validity for the unused portion of the purchased ticket
3. The Company is unable to bear any expenses required for travel such as transportation expenses to a port of embarkation and transportation expenses from a port of disembarkation other than those in the transportation contract.
 
Article 11 (Service Suspension)
1. The Company shall suspend the Service for 30 minutes every day from 2:00am until 2:30 am for maintenance and inspection. However, the downtime for the Service may be changed during operation of late-night services such as during summer peak season, etc. In this case, prior notice will be given on the Company's website.
2. The Company may also temporarily suspend the Service without prior notice in the event of being forced to suspend the Service urgently.
 
Article 12 (Service Restrictions)
1. With regard to use of the Service, there are restrictions on the content of services that can be provided, and services that go beyond these restrictions cannot be provided.
2. The Company may restrict the use of equipment or software in the use of the Service in order to ensure the strength of encryption for the purpose of protecting personal information and to ensure the Service functions. Users shall provide the usage environment at their own expense.
3. In order to protect personal information, the Company shall deem a reservation to be invalid and cancel the Service without saving any information already entered in the event that a reservation application is not completed within 20 minutes of the reservation operation having commenced.
The Company shall bear no responsibility for any losses of the User.
 
Article 13 (Exemption from Liability)
1. Any inconveniences or damages to another person that a User causes through the use of the Service shall be resolved between the parties concerned, and the Company shall bear no responsibility.
2. The Company shall bear no responsibility for any inconveniences or damages that may arise as a result of the User's inability to use the Service due to the reasons in Articles 11 and 12 or due to malfunction of the communications environment.
 
Article 14 (Governing Law)
1. The law of Japan shall apply to the establishment, validity, performance and interpretation of the Terms of Use.
 
Article 15 (Court with Jurisdiction)
1. Any disputes between the User and the Company regarding use of the Service shall be resolved between the parties based on good faith.
2. The court with jurisdiction over the location of the Company's head office shall be the agreed court with exclusive jurisdiction in the first instance for disputes that cannot be resolved between the parties, and disputes shall be resolved in accordance with the law of Japan.
